Terms of Service

These Terms of Service (“Terms”) govern access to and use of Toastfield Outreach (the “Service”), operated by Toastfield (“we,” “us”). By creating a workspace, accepting an invite to join one, or otherwise using the Service, you agree to these Terms on behalf of yourself and, if you’re creating a workspace, the organization you’re creating it for. If you don’t agree, don’t use the Service.
1. What the Service does
Toastfield Outreach helps you discover business leads, draft email campaigns, and send those campaigns through your own connected mailbox (SMTP/IMAP). We provide compliance tooling: a required physical mailing address, a mandatory unsubscribe mechanism, and automatic suppression-list enforcement. But you are solely responsible for the content you send and for complying with applicable law, including CAN-SPAM, CASL, GDPR, and any other law that applies to your sending. We are a tool, not a compliance guarantee.
2. Accounts and workspaces
A workspace is created by its founding owner, who must accept these Terms and our Privacy Policy on behalf of the workspace before it can be used. The owner may invite additional users and assign them a role (owner, admin, or member); each invited user is bound by these Terms as a condition of joining. You’re responsible for keeping your account credentials secure and for all activity under your account.
3. Acceptable use
You agree not to use the Service to:
- Send unsolicited commercial email in violation of CAN-SPAM, CASL, GDPR, or any other applicable law;
- Send to purchased, harvested, or scraped email lists obtained outside the Service’s own lead discovery/import tools, or to any list you don’t have a lawful basis to contact;
- Omit or falsify a required physical address, sender identity, or unsubscribe mechanism, or attempt to circumvent the Service’s compliance safeguards;
- Send content that is fraudulent, deceptive, defamatory, or that infringes anyone’s rights;
- Use the Service for anything other than the business-to-business commercial outreach it was designed for: no bulk consumer marketing, political messaging, or adult content;
- Attempt to gain unauthorized access to another workspace’s data or to the Service’s infrastructure.
We may suspend or terminate a workspace that violates this section, with or without notice, and may report unlawful activity to the relevant authorities.
4. Your own mailbox and third-party services
Sending and receiving mail happens through mail servers you connect (your own SMTP/IMAP credentials); we don’t operate a shared sending relay on your behalf. You’re responsible for complying with your mail provider’s own terms of service and sending limits. Lead discovery uses public OpenStreetMap data; we don’t warrant its accuracy or completeness.
5. Your data and content
You own the leads, campaign content, and other data you put into the Service (“Customer Data”). We only use Customer Data to operate the Service for you, as described in our Privacy Policy. You represent that you have the right to collect and use the lead data you upload or discover through the Service.
6. Fees and plans
Workspaces start on a trial plan with limited usage. Paid plans are billed in advance on a recurring basis at the rate shown at checkout or in your order form, and fees are non-refundable except where required by law. We’ll notify you before any price change takes effect on your next billing cycle.
7. Term and termination
These Terms apply for as long as you use the Service. We may suspend or terminate a workspace for a violation of Section 3, non-payment, or if required by law. You may stop using the Service at any time; contact us to request deletion of your workspace and its data.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOUR USE OF THE SERVICE WILL COMPLY WITH ANY PARTICULAR LAW. COMPLIANCE WITH APPLICABLE EMAIL MARKETING LAW IS YOUR RESPONSIBILITY.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOASTFIELD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
10. Indemnification
You agree to indemnify and hold us harmless from any claim arising from your use of the Service in violation of these Terms or applicable law, including claims arising from the content of your campaigns or the lead data you process.
11. Changes to these Terms
We may update these Terms from time to time. Material changes require every workspace to re-accept before continuing to use the Service. The “Effective” date above reflects the current version.
12. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
